Installation Terms and Conditions

I. SCOPE OF INSTALLATION SERVICES

Eos Loan, a brand of EOS Solar Inc (NMLS #2744537) (“Eos”), does not perform installation services directly. Installation of battery systems, energy-storage equipment, smart panels, gateways, controllers, or related components (the “Equipment”) is performed exclusively by independent, third-party licensed electricians or contractors (“Installer”). Installation may include an on-site evaluation by a licensed electrician; installation of battery systems and related electrical components; and replacement of an existing panel or installation of a sub-panel or gateway, subject to site conditions. Unless agreed in writing, installation does not include solar/PV wiring, integration with existing solar arrays, debris removal, wall restoration, painting, or cosmetic repairs.

Installation requires that the property’s electrical system comply with applicable law (including the National Electrical Code), that no unauthorized electrical modifications exist, and that the site be deemed safe, accessible, and feasible by the Installer, who retains sole discretion to proceed. Installation is available only in selected regions based on ZIP-code eligibility and Installer coverage. Eos facilitates access to financing and coordinates the overall solution but does not control, supervise, or guarantee installation services, which are conditional on credit approval (when applicable), Installer availability, and compliance with installation requirements.

II. INSTALLATION FEES AND ADDITIONAL COSTS

If a standard installation fee is quoted, it generally covers labor for basic installation only (typically within ~2 feet of the existing panel, no structural modifications, no system upgrades); exact scope is determined by the Installer. Costs not included — and payable directly to the Installer — include materials and hardware; panel upgrades beyond standard scope; permit and inspection fees; engineering or stamped plans; structural work; extended wiring; travel outside standard areas; and on-site assessment fees. Permit-fee estimates are provisional; actual permit costs exceeding any pre-collected amount are paid by the customer. Eos does not collect, control, or refund installation-related payments unless expressly stated.

III. SERVICE LIMITATIONS AND LIABILITY

Installation is a direct agreement between the customer and the Installer; Eos is not a party, assumes no responsibility for pricing, workmanship, timelines, or quality, and provides no installation warranty. Eos is not responsible for damage, malfunction, or safety issues arising from work by unauthorized or unlicensed installers, which may void warranties. Once installation has commenced, installation fees are generally non-refundable; if equipment removal is requested after installation, removal and restoration costs are the customer’s responsibility. If installation is canceled after an on-site assessment but before work begins, installation fees may be refunded and assessment/visit fees may be deducted (up to USD $500, depending on location).

Right to cancel (home solicitation). If your purchase results from a sale at your home, you may have the right to cancel the transaction within three (3) business days under the FTC Cooling-Off Rule and applicable state home-solicitation laws; see your Notice of Right to Cancel for details and instructions.

IV. CUSTOMER RESPONSIBILITIES

Customers must provide accurate personal information, installation address, and access details; a responsible adult must be present during installation; and rescheduling must be requested at least one (1) business day in advance. The customer is responsible for ensuring the property is accessible, the electrical infrastructure meets requirements, and necessary permissions are obtained; delays or added costs caused by site conditions are the customer’s responsibility.

V. DISCLAIMER AND FINAL INTERPRETATION

Installation services may be delayed or interrupted due to force majeure, regulatory delays, Installer availability, or customer-related issues, for which Eos is not liable. To the maximum extent permitted by law, Eos shall not be liable for indirect, incidental, or consequential damages related to installation services, and any liability is limited to amounts paid directly to Eos for services under its control. Drilling, mounting, and minor structural alterations are considered normal; neither Eos nor the Installer is responsible for cosmetic restoration unless expressly agreed.

Energy services. If the installed Equipment is a battery or energy-storage System that you finance with Eos, its operation and any virtual power plant or energy-program participation are governed by Section 22 of the Terms of Use.

HOW YOU ACCEPT

You accept these Installation Terms and Conditions electronically by checking the box in your Eos Loan application or account. Eos records your acceptance — including the date and time and the version you accepted — which, under the federal E-SIGN Act, serves as your signature and has the same legal effect as a handwritten one. You may request a paper copy.
