Electronic Signatures, Communications and Records

DEFINITIONS

“Eos,” “we,” “us,” and “our” refer to Eos Loan, a brand of EOS Solar Inc (NMLS #2744537), and its successors, assigns, affiliates, service providers, and contractual partners involved in providing financing and related services. “You” and “your” refer to the individual or business entity providing consent.

“Records” means all documents, disclosures, agreements, notices, authorizations, and communications related to your application for and use of Eos services, including credit applications; financing agreements; disclosures required by law; billing statements; payment authorizations; transaction histories; consent forms; policies and notices; the energy data and Virtual Power Plant authorizations (Terms of Use Section 22); your acknowledgment of automated decisioning (FCRA Disclosure); and, where applicable, investor subscription documents; and any other information related to the solution or services you request from Eos.

SCOPE OF CONSENT

By providing your consent, you agree to conduct transactions with Eos electronically, including the use of electronic signatures. You understand and agree that your electronic signature may consist of clicking buttons, checking boxes, or taking other electronic actions where indicated; that Records may be provided electronically instead of on paper; and that Records may be delivered by email, made available through your online account, or provided via secure links. Your consent applies to your current application and related agreements and to any future transactions or amendments that relate to, modify, or extend your original agreement with Eos. This consent remains effective unless withdrawn as described below.

UPDATING YOUR CONTACT INFORMATION

You agree to provide accurate and current contact information, including a valid email address and phone number, and to promptly notify Eos of any changes. If electronic communications to your email are returned undeliverable for an extended period, Eos may treat your consent as withdrawn and provide Records in paper form when required.

OBTAINING PAPER COPIES

You may request a paper copy of any Record by printing it or contacting Eos support. Eos may charge a reasonable fee where permitted by law. Requesting a paper copy does not withdraw your consent to receive Records electronically.

WITHDRAWING CONSENT

If you do not consent to electronic signatures and electronic Records, you will not be able to complete your application or proceed with Eos services. After completing your application or entering into an agreement, you may withdraw your consent at any time by contacting Eos support; Eos will then provide future Records in paper form where legally required, at no fee, and withdrawal will not affect the validity of Records previously provided electronically.

HARDWARE AND SOFTWARE REQUIREMENTS

To access, review, and retain electronic Records, you need a computer, smartphone, or tablet with internet access; a current web browser supporting standard encryption (Chrome, Safari, Firefox, Edge); access to your account email; sufficient storage to retain Records; a printer if you wish to print; and software capable of viewing PDF files. If these requirements change materially, updated requirements will be presented and your renewed consent may be required.

Consent is captured electronically before electronic disclosures are provided, in a manner that reasonably demonstrates you can access information in the electronic form that will be used (E-SIGN, 15 U.S.C. § 7001(c)). By providing your consent and accessing this agreement electronically, you confirm that you meet these requirements.

HOW YOU ACCEPT

You accept this Electronic Signatures, Communications and Records consent electronically by checking the box in your Eos Loan application or account. Eos records your acceptance — including the date and time and the version you accepted — which, under the federal E-SIGN Act, serves as your signature and has the same legal effect as a handwritten one. You may request a paper copy.
